Dr. Chris Totten and MSCJ student Jonathan "Caleb" Lang publish an Article in the Criminal Law Bulletin

KENNESAW, Ga. (Sep 10, 2019) — Dr. Christopher Totten, Professor of Criminal Justice (Law) and Director, MSCJ program and current MSCJ student Jonathan “Caleb” Lang recently co-authored a publication in the Criminal Law Bulletin ("CLB").   The Article, entitled "Interpreting Maryland v. King: A Study of Significant State Court Cases," appears in Volume 55, Issue 4 of the CLB.  The citation is:  Totten, C.D. & Lang, J.C. (2019). Interpreting Maryland v. King: A Study of Significant State Court Cases.  Criminal Law Bulletin, 55, 635-684.  The CLB is a refereed journal that currently ranks third (3rd) among peer edited journals in the United States in the field of criminal law and procedure.

 The article abstract is as follows:

In Maryland v. King, the United States Supreme Court sanctioned warrantless, non-consensual oral DNA swabs of certain criminal arrestees for identification purposes at the time of booking. In the approximately six years since King was decided, state courts have put forth various, sometimes divergent interpretations of King. This content analysis study of the significant state court interpretative case law aims to evaluate and synthesize this law, including by identifying any trends and/ or emerging trends. Various policy implications of the jurisprudence for criminal justice actors and Fourth Amendment privacy are also explored.
